Please read these Terms of Service (the "Terms") carefully, as they govern your (i) access to and/or use of the website located at rfccheck.com (the "Website"); (ii) the acquisition of any services (the "Services") from NextGenAPI Creators Inc. (the "Company") offered through the Website or involving access to and/or use of the RFC Validation API (the "API"); and (iii) the possession and/or use of any personal data accessed or provided through the Services. By accessing or using the Website or the API or by acquiring any Services, you are entering into a legally binding Agreement (the "Agreement") with the Company to be bound by these Terms. If you are entering into this Agreement on behalf of a company or other legal entity, you also represent that you have the authority to bind such entity to these Terms, in which case the terms "you", "your", or "customer" shall refer to such entity. If you do not have such authority, or if you do not agree to these Terms, you must not accept this Agreement and may not use the Website, the API, or the Services.
NextGenAPI Creators Inc. provides API-based identity verification services, specializing in the validation of Mexican RFC (Registro Federal de Contribuyentes) numbers to meet customer identification needs and enable trusted customer transactions.
The purpose of the Website is to facilitate the provision of identity verification services by providing developers easy access to RFC validation data.
The Services consist of providing access through the API to validate Mexican RFC numbers in order to facilitate identity verification by individuals and/or entities engaged in identity verification. Through the Services, a User/developer can use the API to validate RFC data through simple REST endpoints.
The Company grants the User a non-exclusive, revocable, non-sublicensable license to access and use the Website, the API, and the Services in a manner and scope consistent with these Terms and the specific Services acquired. The licenses granted do not include any right to: (a) damage, disable, or impair the Website, APIs, or Services; (b) copy the Website, APIs, or Services or any part, feature, function, or user interface thereof; (c) modify, redirect, create derivative works, obtain source code, reverse engineer, disassemble, or tamper with the Website, APIs, or Services, or attempt to do any of the foregoing.

Company's privacy obligations. Users should carefully read the privacy policy found at the "Privacy Policy" page, as it is incorporated into this Agreement by reference and governs the Company's treatment of any personal information collected by the Company or submitted by a User to the Company in connection with the use of the Website, API, or Services. The User hereby consents to the Company processing personal data that the User provides in connection with the Services in accordance with the Privacy Policy. In connection with the Website, API, and Services, the Company represents and warrants that it will comply with all applicable data protection and privacy laws.
User's privacy obligations. In connection with the Services and any personal data the User accesses or receives through the API or Services, the User represents and warrants that (i) it will comply with all applicable data protection and privacy laws, (ii) the User has all legally required consents and authorizations from the relevant rights holders to access and use the personal data available through the Services, and (iii) the User will only use personal data obtained as permitted by applicable laws and regulations.
The Company and the User represent and warrant that, in connection with any personal data or confidential information received under this Agreement, they will maintain appropriate and commercially reasonable organizational, physical, and technical safeguards to protect the security and integrity of any personal data or confidential information received during the term of the Agreement. The User acknowledges that it is aware that the security of the use of the Services depends largely on the security of the network through which the User accesses the Services.
The Company is the sole and exclusive owner of all intellectual property rights in the Website, the API, and the Services, including but not limited to all copyrights, trademarks, trade secrets, and any other legally protectable intellectual property rights. The Company does not claim any ownership over data obtained through the API.
The Website, the API, and the Services are made available and provided "as is". The Company specifically disclaims all warranties of any kind with respect to the API and the Services, whether express, implied, or statutory, including, without limitation, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. The Company does not warrant that the API or the Services will always remain uninterrupted, timely, secure, or error-free beyond the Company's control. Likewise, the Company shall not be responsible for failures in Internet service, interruptions in server power service, or any technical failure not directly attributable to the Company's Services. This disclaimer shall apply to the extent permitted by law in those jurisdictions that may limit the exclusion of implied warranties.
Notwithstanding any damages you might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Services or one hundred ($100.00) U.S. dollars if you have not purchased any of the Services.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
You hereby release the Company from any and all liability, costs, claims, causes of action, damages, and expenses (including reasonable attorneys' fees) arising out of or in any way related to your breach of any of the provisions of these Terms.
Severability. If any provision of these Terms is found to be unenforceable or invalid, such provision will be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver. Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation interpretation. These Terms may have been translated from the English original into other languages. You agree that the original English text shall prevail in the event of a dispute.
Modifications or updates to the Website, Services, or API. The Company may at any time, without notice and without liability, make corrections, additions, improvements, or modifications to the Website, Services, or API.
Governing law, jurisdiction, and dispute resolution. Any claim, dispute, or controversy of any nature ("Claim") arising out of or relating to this Agreement, the Website, the API, or the Services shall be resolved in the state or federal courts located in the United States, and the User agrees to the exclusive jurisdiction of such courts. This Agreement shall be governed by and construed exclusively under the laws of the United States.
Links to other websites. This Website contains links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Amendments or modifications of these Terms. The Company may amend, modify, or terminate any of these Terms at any time and such amendment, modification, or termination will be effective at the time the Company posts the revised terms on the Website. Your continued use of the Website or the Services after the Company has posted the revised terms means that you accept such revised terms.
